ā€˜Mom, canā€™t we stay togetherā€™

My heart was writhing in pain, when my little son put his arms around my neck and asked me that question. I didnā€™t know what to say. His father has told him that they both will go away somewhere. I tried hard to withhold my tears. I suppressed a monstrous thunder in my heart and said rather indifferently, ā€˜Yes, we can stay together. Not sure why he said thatā€™. The pain of watching my home braking down in front of my own eyes was unbearable.

The 7-year-old did not know that the mother who had kept him in her heart for so long, the mother who spent every day of her life thinking only about him, the same mother is no longer required in that family.

I am not good-looking. You can say I am merely an average-looking girl compared to other Bengali beauties around. I have never wasted my time in flirting with other boys. Thatā€™s why when I fell in love with Supriyo, I fought with my entire family to marry him. I trusted him. I have never thought that I was highly educated compared to him and was also working in a government entity. Even I left that job after our son was born. Even my brothers are all highly educated. They tried to stop me from marrying but I didnā€™t listen to them. I had complete trust in Supriyo because I loved him. I thought we could spend the whole life together.

I didnā€™t have a very big dream. I only wanted a small and happy family. So, after my son was born, I wanted to make him my life. Crafted all my dreams around him. I left my job for him. Otherwise, who would look after the kid? For seven long years, I have taken all care of him. I was always available to take care of his tantrums.

My in-laws eat the same food every day, day and night. Simple Dal, fish curry or chicken/mutton. They hardly want any variety of vegetables available in the market. Nowadays boys are going to other cities for work. Who knows if my son will also not end up in any of those different cities? So, I wanted to create a habit in him so that he developed taste for everything, like vegetables, different varieties of fish, even Neem leaves (ā€˜fired tender neem leavesā€™ is a delicacy for many Bengalis and there are many who hate that taste as well).

Supriyo and his family didnā€™t like neem leaves. So, whenever I tried to give him neem leaves, they used to protest but by then my son had developed taste buds for neem leaves. There were times we had quarrel because of this difference in food habits. I always thought if my son has to go to other cities like Chennai or Bangalore, how will he survive? But they didnā€™t understand. Slowly they started committing violence on me. They started both verbal and physical abuse on me. Even there were times when Supriyo wanted to throttle me to death.

Out of fear, I couldnā€™t even tell my family members about these atrocities. I got married after fighting with them. I had boasted about Supriyo to my brothers before marriage. How could I tell them that my in-laws were torturing me?

It was my in-laws who called my family a couple of times and asked them to take me back. He was not able to live with me. My parents scolded me and asked me to behave and listen to them. Everyone thought we will resolve the matter within us.

But that has never happened. As our son grew up, I became busier with him. Making different types of tiffins every day, cooking new food to alter his taste buds etc. But neither my husband nor my mother-in-law was interested in those. I requested them enough but didnā€™t get any result. But I had to teach my son to get used to different types of food.
Thatā€™s why my sonā€™s words pierced me even more today. I donā€™t want to leave them, I never did. So, in spite of being highly educated, despite working in a govt entity (in WB people are crazy for govt jobs as they are secure), I wanted to keep my family close to me. I left my job for my child, despite that his father is teaching him that they would start living separately.

I donā€™t understand feminism. Thatā€™s why when my brothers asked me to file DV case against them, I didnā€™t. That is why even after so much of abuse I am living there.

In last 2-3 months abuses have increased many folds. Over and above that they started threatening to throw me out of their house. I didnā€™t know when the family that I wanted to cling to my heart, expelled me from their heart.

I was thinking about what happened all of a sudden. In the last 2/3 months, their abuses have increased without any reason. He doesnā€™t speak to me nowadays. If I make tea for him, he throws the tea on my face; tries to throttle me. I donā€™t know what sin I have committed. I am not good-looking ā€“ is that my fault? I wanted to live with my family, is that my fault?

Nowadays he is always on his phone. One day, all of a sudden, I checked his phone. It was not locked by mistake. After reading a few messages from one of the girls who are our common friend, I was shocked. He is in an illicit relationship with her. They also have a physical relationship between them. My inner self dried up when I read those intimate, indecent and sexual messages. My head started spinning. I didnā€™t know what to do. I sat still in one place. They have a physical relationship for the last few months.

After reading the message, my whole world turned black. The family that I was decorating with care, the child that I was raised with all my love and affection, went away from me. As if, someone taught me that because I am not good-looking, I canā€™t dream about a happy family. I donā€™t have any right to love someone the way I want. All these can be snatched from me at any moment.

I donā€™t understand laws. I donā€™t want to know what cases I can file. I only know that I donā€™t have the right to have a happy family. Someone said adultery is legal now. That is why neither my husband nor that girl is an offender. This is their ā€˜rightā€™ but what about mine?

Some people said, ā€œYou will get alimony and child custody too. Your husband will pay for all that.ā€ But Supriyo has negated everything. He said, ā€œI will pay for my child, but why should I pay for you? You can file cases if you want and see what happens.ā€

I have one question for you. Did we forget to look at our life without law and cases? The family I want is now breaking down. Itā€™s another woman who is breaking it. So, will those good-looking women continue to break our families like these? Then what will happen to average women like us?

Today he is telling he will not give me alimony but want to break my family. I sacrificed my job for this family many years ago. Will I get a job now? Will even a man get a job after not working for years?

I am not a feminist. Thatā€™s why I didnā€™t file any case so far. I want to get back my family. Am I doing something wrong? Why there is no system (or law) to stop adultery in this society? Isnā€™t it causing more harm to women like me? And you my elder brothers, will you support men like my husband? Do you want to fight for their rights? What would you have done, if I was your own sister?

I donā€™t know why I am feeling that I am only garbage now.

Your story is indeed heart-wrenching and saddening. I can assure you that MRAs donā€™t support any form of crime against women but before deciding anything on your case I would like to hear your husbandā€™s side of the story.

We have already noted that while striking down IPC 497 or adultery law, Supreme Court has gone overboard with comments on fundamental rights that gave this society a wrong message that ā€˜adultery is a rightā€™ to married couples. We have also noted a sudden surge of open adultery cases in our society and particularly in Bengal.

But itā€™s our media who is responsible for this situation, not the Supreme Court. Supreme Court in its judgement on IPC 497 clearly said, ā€œThere can be no shadow of doubt that adultery can be a ground for any kind of civil wrong including dissolution of marriage.ā€ (page 46 of Writ Petition (criminal) No. 194 of 2017 or IPC 497 judgement given in September 2018). But it was our media that wanted a piece of viral news and hence projected it in such a way that it turned out to be no ā€˜offenceā€™.

Your husbandā€™s case may also be a fallout of the recent SC verdict. When the adultery law needed to be strengthened while removing that section from criminal law category it sent a wrong message that adultery is a ā€˜rightā€™ but in reality, it is not so. It is still a civil offense and you can get a divorce for your husbandā€™s adultery.

Also, I personally support adultery not being a criminal offense. Because other than filing a criminal case under IPC 497 (against wifeā€™s paramour) even husbands didnā€™t have any recourse (wives couldnā€™t file a case under IPC 497). Proving adultery beyond a reasonable doubt, as happens in criminal sections, was just impossible. So, while striking it down, our SC could have strengthened the civil provisions to stop such open abuse of our family system.

  1. Right decision to not misuse the laws even in a situation like this. It is very important for daughters to be given equal property and any working woman should at least have some savings before she gives up her job. That way one doesnā€™t have to think about financial security when you walk out of a situation as such. People have affairs when they are characterless and when there is no fear of punishment and few people end up having affairs when they suffer from a partner(not right either and always better to walk out first). But without any punishment for adultery, such cases will only increase in number and less effort on making the marriage work. You have not misused the laws but many will end up misusing other laws as adultery is not punishable.
